Terms and Conditions

Welcome to TryPosty, a product of Zyene, Inc., a company incorporated in the State of Delaware with headquarters in San Francisco, California ("Zyene", "we", "us").

1. Acceptance of terms

By using the TryPosty website, web app or related services (the "Service"), or by creating an account, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service for a business, you agree to these Terms on its behalf and confirm that you have the authority to do so.

2. Description of service

TryPosty helps small businesses create and publish social media content. It can read your website to learn your brand, generate images, carousels, videos and captions, publish to the social accounts you connect, and show you how your posts perform. Features depend on your plan.

3. AI and automated features

Much of the Service is generated by AI. Output may be wrong, may not match your brand, or may resemble content made for others. You are responsible for reviewing content before you publish it, including checking any claims, prices, offers and legal statements in it.

4. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement.

5. Subscriptions, billing and cancellation

• Plans. Current plans, prices and credit allowances are on our pricing page. Stripe processes payments.
• Renewal. Paid plans are billed immediately when you subscribe and renew automatically at the end of each billing period until you cancel.
• Credits. Generating content uses credits. Unused credits expire at the end of each billing period and when your plan ends. Credits have no cash value and cannot be transferred. Credits used on a failed generation are returned.
• Cancellation. Cancel on the Subscription page in your dashboard. Cancelling stops future renewals but does not refund past charges, and your plan stays active until the end of the paid period.
• Failed payments. Stripe may retry a failed renewal, and we may email you to update your payment method. If payment still fails, we may end your plan.
• Changes. We will give advance notice by email or in the app of material changes to prices, renewals, cancellation or refund terms.

5.1 Money-back guarantee

A 3-day money-back guarantee applies only to your first subscription charge. To use it, email support@tryposty.net from your account email within 3 days of that charge.

5.2 No refunds after the window

Once those 3 days have passed, and for all renewal charges, we do not give refunds for a change of mind, unused time or partial billing periods, except where the law requires it or for confirmed billing errors or unauthorized charges.

5.3 How to request a refund

Email support@tryposty.net from your account email with the reason, the date and amount of the charge (a Stripe receipt helps), and whether the guarantee or an exception applies. We send approved refunds to Stripe within 5 to 10 business days. Your bank may take another 5 to 10 business days to post the credit.

5.4 Chargebacks and disputes

Please contact us before disputing a charge with your bank. If you dispute a charge, we may share subscription records, checkout details, emails and usage data with Stripe and your bank. Fraudulent chargebacks may lead to account closure.

6. Free previews

You may use a free preview without an account. Previews are limited each day, are publicly viewable by anyone with the link, and stop being available after 30 days. Only submit a website that you own or have permission to use.

7. User accounts

7.1 Account creation

You create an account with an email address and password. You must give accurate information.

7.2 Account security

You are responsible for protecting your password and for all activity on your account. Tell us promptly at support@tryposty.net if you suspect unauthorized use.

7.3 Account termination

We may suspend or terminate your account if you violate these Terms or if you use the Service for fraudulent, abusive or illegal activity.

8. Your content and connected accounts

8.1 Your content

You keep ownership of what you give us. As between you and Zyene, the content TryPosty creates for your business is yours, subject to the rights of third parties in any stock media, fonts or other material it includes.

You give us a limited license to host, copy, process and publish your content only as needed to provide the Service, including sending it to our service providers.

You are responsible for your content and for having the rights to everything you upload.

8.2 Connected accounts

When you connect a social account, you authorize us to act on your behalf to publish the posts you choose and to read the data shown in the Service. You must follow each platform's terms. We do not control platforms and are not responsible if one rejects a post, limits your reach, changes its features or suspends your account.

9. User data and privacy

Our Privacy Policy explains how we handle your information and forms part of these Terms. We do not sell your personal information.

10. Acceptable use

10.1 Permitted use

You may use the Service to create and publish content for your own business or for a business you are authorized to represent.

10.2 Prohibited activities

You agree not to:

• Use the Service for anything illegal, or publish content that is false, deceptive, hateful, harassing, sexually explicit or harmful to minors
• Infringe anyone's intellectual property, privacy or publicity rights, or impersonate a person or business
• Use the Service to send spam or to manipulate social platforms
• Submit a website or connect an account that you are not authorized to use
• Gain unauthorized access to the Service, or get around its credit or usage limits
• Reverse engineer the Service, or use bots or scrapers on it
• Resell or redistribute the Service without our written permission
• Disrupt or overload the Service

11. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent allowed by law.

We do not guarantee that AI output will be accurate or fit for your purpose, that a post will publish successfully, or that you will gain followers, reach, leads or sales. We do not guarantee uptime, error-free operation or that the Service will work with any particular platform or device.

12. Limitation of liability

To the maximum extent allowed by law, Zyene is not liable for lost profits, lost revenue, lost data, damage to your reputation, social account suspensions, or any indirect, incidental or consequential damages. Our total liability for any claim relating to the Service is limited to $100 USD.

13. Indemnification

You agree to indemnify and hold harmless Zyene and its developers and affiliates against claims arising from your violation of these Terms, your use or misuse of the Service, your content, or your violation of any third party's rights.

14. Intellectual property

14.1 Our rights

Zyene owns the Service, including its code, design, templates, logos and text. Your content is covered by section 8.

14.2 Your rights

We give you a limited, non-exclusive, non-transferable license to use the Service under these Terms. You may not copy, modify or create derivative works of the Service without our permission.

15. Third-party services

The Service relies on third parties, including the social platforms you connect and the service providers listed in our Privacy Policy. Their own terms may apply, and we are not responsible for their services.

16. Modifications to terms

We may change these Terms at any time. Changes take effect when posted. We will tell you about material changes by email or in the app and will update the date at the top of this page. If you keep using the Service after a change, you accept the new Terms.

17. Governing law and dispute resolution

17.1 Governing law

These Terms are governed by U.S. federal law and the laws of the State of Delaware, without regard to conflict-of-law principles.

17.2 Binding arbitration

If you have a dispute with us, first email support@tryposty.net so we can try to resolve it informally within 30 days. If we cannot, the dispute will be settled by binding arbitration under the rules of the American Arbitration Association, held exclusively in San Francisco County, California.

18. Severability

If any part of these Terms is found invalid, the rest stays in effect.

19. Entire agreement

These Terms and our Privacy Policy are the entire agreement between you and Zyene about the Service.
